Are there exceptions for certain pieces of equipment?

The following products are not subject to the law:

equipment that serves to protect the essential security interests of the Federal Republic of Germany including weapons, munition and related material that is only determined for military use
equipment that is installed as a component in another device that is excluded from the scope of this Law or is not subject to the application scope of this Law and that can only fulfill their function especially as part of this other device
light bulbs
equipment items for use in Space
stationary industrial tools
stationary industrial large plants
transport modes for people or goods

But please note: the law applies to electric two-wheeled vehicles for which no type approval is required!

mobile machinery
equipment that is exclusively designed especially for research and development and is only provided on an intercompany level
medical equipment and in-vitro-diagnostics of which is to be expected that they will become infectious prior to termination of their life-expectancy
active implantable medical equipment

ElektroG does not normally apply to means of transport.

But the law applies to:

electrical and electronic equipment that is not determined for use in transport, such as for example toy cars, roller skates, roller blades and electric walking frames
electric two-wheeled vehicles for which no EU type approval is required

Mobile machinery is not subject to the law, if they meet the following requirements:

They are exclusively used Sie outside private households werden ausschließlich außerhalb von privaten Haushalten genutzt.
They have their own energy source for locomotion.
They are continuously in motion during the work process.

No mobile machinery are for example vacuum cleeners. They are subjact of the law.

Agricultural and forestry tractors and machinery (e.g. combine harvesters), aerial work platforms and road construction machinery are not subject of the ElektroG.

Medical equipment and in-vitro-diagnostics and ctive implantable medical equipment are not subject to ElektroG.
When an equipment is to be considered infectious and therefore is out of scope must in principle be decided individually.

The following guidelines apply though:

A b2c equipment generally counts as infectious if the equipment is determined to be in contact with blood and fluid can be retained for more than a few days.
A b2c equipment that only incidentally has contact with blood is generally not to be regarded as infectious.
Infectivity can generally be excluded for re-usable b2b electrical and electronic equipment due to the existing legal or subordinate obligations to decontaminate prior to re-use or respectively prior to transfer to disposal. This does not apply to medical products for single use, where infectivity must be checked in each case individually.
