1. Subject of regulation
This rule determines the types of equipment for category 2.
According to § 37 paragraph 1 clause 1the responsible authority registers a producer or respectively authorised representative (§ 3 number 10 ElektroG) on their application among others with a type of equipment.
The type of equipment is basis for the producer obligations according to ElektroG.
Each category can contain both such electrical and electronic equipment that can be used in private households (§ 7 paragraph 1 clause 1 ElektroG, so-called ‘b2c equipment’), as well as electrical and electronic equipment that exclusively is used in other than private households and such equipment that is usually not used in private househoulds (§ 7 paragraph 3 clause 1 ElektroG, so-called ‘b2b equipment’). Dual-use-equipment, meaning electrical and electronic equipment that can be used both in private households, as well as commerically, is allocated to b2c equipment.
According to these legal requirements, the following types of equipment are determined in the category screens, monitors and equipment containing screens having a surface greater than 100 cm² in consideration of the producers and authorised representatives (§ 3 number 10 ElektroG), or respectively product areas:
- Screens, that can be used in private households
- Screens for use in other than private households only
