As treatment facilities according to § 12 section 1 and 2you are obligated to take over waste batteries should they occur in your facility. In the following you can find a summary of your obligations according to § 12 BattG.
Waste portable batteries
As operator of treatment facilities for
- waste equipment and
- waste vehicles according to the waste vehicle regulation
you must submit collected waste portable batteries to a collection scheme that you join for at least 12 months. This connection to a collection scheme is extended by further 12 months if you do not terminate this at the latest 3 months prior to expiration of the agreed upon duration, or respectively, 3 months prior to the expiration of the minimum term.
The collection scheme must provide to you free of charge suitable collection containers and transportation containers according to the legislation for dangerous good, as well as further packaging required according to legislation for dangerous goods. The minimum pick-up amount for a pick-up free of charge is 90 kilogrammes. Lower pick-up amounts can be agreed upon with the collection scheme. Waste portable batteries must be picked up within 15 work days.

Waste automotive and industrial batteries
The producers of automotive or industrial batteries or their authorised agents are obligated to offer a reasonable a free-of-charge option to return waste automotive or industrial batteries accruing at the treatment. Deviating agreements are possible between the affected participants. As an operator of treatment facilities you are not obligated to make use of this return option offered.
Should you not make use of this return option, you must either recover the collected waste automotive and industrial batteries according to § 14 Batt G yourself, or submit these to a commercial waste battery disposer with the target of recovery. Should anvoluntarily accept waste automotive batteries, you may hand over these waste batteries to the örE with the target of recovery.
