Distributor

As a distributor you are obligated to take back those types of batteries that you have or had in your range as waste batteries free of charge directly in your shop or in direct proximity thereof.

You are a distributor if you, regardless of your method of distribution, professionally offer batteries in Germany for end users. This also means the presentation of batteries directed at concluding a sales contract or making batteries publicly accessible. This also covers the invitation to tender (see § 2 section 14 BattG).

Your collection obligation is limited to the amount that end users usually dispose of. In the case of mail order, your dispatch warehouse counts as your commercial business. 

Waste portable batteries

You must submit the collected waste portable batteries to a collection scheme that you join for at least 12 months. This connection to a collection scheme is extended by further 12 months if you do not terminate this at the latest 3 months prior to expiration of the agreed upon duration, or respectively, 3 months prior to the expiration of the minimum term. 

The collection scheme must provide to you free of charge suitable collection containers and transportation containers according to the legislation for dangerous good, as well as further packaging required according to legislation for dangerous goods. The minimum pick-up amount for a pick-up free of charge is 90 kilogrammes. Lower pick-up amounts can be agreed upon with the collection scheme. Waste portable batteries must be picked up within 15 work days. 

Important: If you do not reach the required minimum pick-up amount of 90 kilogrammes in one calendar year, you can demand a one-time collection of the taken-back waste portable batteries.

Waste automotive and industrial batteries

The producers of automotive or industrial batteries or their authorised agents are obligated to offer a reasonable a free-of-charge option to return waste automotive or industrial batteries that were taken back. Deviating agreements are possible between the affected participants. As a distributor you are not obligated to make use of this return option offered. 

Should you not make use of this return option, you must either recover the collected waste automotive and industrial batteries according to § 14 Batt G yourself, or submit these to a commercial waste battery disposer with the target of recovery. Should an örE voluntarily accept waste automotive batteries, you may hand over these waste batteries to the örE with the target of recovery.
