Annual guarantee allocation

As proof of guarantee must be submitted for every calendar year (§ 7 paragraph 1 clause 1 ElektroG), even producers/authorised representatives already registered must submit a proof of guarantee for their b2c equipment prior to the end of one calendar year for the following calendar year. 

If you have an individual guarantee, please edit ‘Garantiegültigkeitszeitraum anlegen ’ in the ear-portal to set up a guarantee validity period. If the proven guarantee amount does not cover a past guarantee validity period (GGZ) (for instance, because you placed more electrical and electronic equipment on the market than planned), you will receive the task ‘Zugeordneten Garantiebetrag erhöhen’ (to increase allocated guarantee amount) in the ear-portal. 

If the total guarantee amount has already been exhausted to collateralise prior GGZ or respectively further types of equipment, you must first increase your suretyship or respectively the deposit as a surety in its amount: 

  • In case of a suretyship you can have your bank or insurance create an amendment that increases the suretyship amount under the same contract number.
  • If you have provided proof of guarantee via deposit as surety at the local court in Germany, you apply to the deposit facility to increase the deposit amount under the file reference (deposit number/HL) of the already existing deposit. 

Important: In both cases you should – so as not to trigger renewed fees for the first-time check of  an individual guarantee – make sure that you do not create a new suretyship or deposit, but just increase the existing surety.

As a producer/authorised representative with a collective guarantee you must get in touch with your guarantee service provider to ensure the additional equipment amounts through participation in the producer guarantee system prior to editing the ‘Garantiegültigkeitszeitraum anlegen’ (to set up a guarantee validity period), or respectively ‘Zugeordneten Garantiebetrag erhöhen’ (to increase the allocated guarantee amount) in the ear-portal.

Note: If you proof guarantee via participation in a producer guarantee system the increase of the total guarantee amount is the guarantee service provider’s responsibility. 

Guarantee update reminder

If the tasks on proof of guarantee are not edited in time in the ear-portal, stiftung ear will send a ‘Erinnerung an den Nachweis einer insolvenzsicheren Garantie’ by email to remind you to submit proof of an insolvency safe guarantee . This is how we bring your attention to the fact that your company has not fulfilled its legal obligation to submit proof of an insolvency safe guarantee, or that it is not for a sufficient amount. 

Important: After receiving such a message you should immediately introduce any necessary steps to prove any equipment amounts that are not yet collateralised. Please consider that proof of guarantee is the imperative prerequisite to uphold your b2c registration(s).
